Article 1 Applicability
Our General Terms and Conditions of Sale apply to every offer we make as an Online Retailer to you (in your capacity as a consumer) and every agreement concluded between us.
Before an Agreement is concluded between us, we clearly bring the text of these General Terms and Conditions of Sale (as well as the other parts of the General Terms) to your attention and ask you to accept them. The General Terms are clearly made available to you with the option to store them on a durable medium. If for any reason we are unable to show you our General Terms, you may obtain a copy or view them by sending an email to info@theghentist.com.
The General Terms are made available to you before you confirm your order on the website. A web link is used for this purpose. Via this web link you can obtain the general terms in a format that you can save or print. We also recommend that you always do so. You will check a box confirming that you have read and fully accepted the General Terms.
If in addition to these General Terms, additional special conditions also apply, the above regarding acknowledgement and acceptance also applies to those special conditions. If our General Terms conflict with those special conditions, you as a consumer may always invoke the most favourable text in your favour.
Article 2 Our Offer and Your Order
If an offer has a limited validity period or is subject to certain conditions, we state this explicitly in our offer.
We strive to always describe as fully and accurately as possible what we sell to you. We endeavour to provide the description in sufficient detail to allow you to make a proper assessment. Where we use images, we try to make them a truthful representation of the goods and/or services offered. However, online representations may differ from reality, taking into account differences that may arise when creating the representation (e.g. photo) and the way it is displayed on screen (and the settings you use for this). Theghentist.com cannot be held liable for any differences between the representation and reality. To the extent you wish to withdraw from the sale, you may exercise your right of withdrawal within the limits indicated.
Your order is complete and the agreement between us is final once theghentist.com confirms your order by email. As long as you have not received confirmation from us, you can still cancel your order.
The Customer has the option to review the order. The Customer can enter a discount code if applicable and has the option to add comments regarding their order. The Customer expressly accepts the General Terms by checking the box ‘By clicking ‘Place order’ I place an order with an obligation to pay and agree to the general terms and conditions.’ By subsequently clicking the ‘Place order’ button, the order is placed and the payment procedure begins.
By ordering online, the buyer declares to TheGhentist that they have reached the legal age of 18 to purchase and/or consume alcoholic beverages. TheGhentist reserves the right to refuse an order due to a serious shortcoming of the Customer with respect to orders in which the Customer is involved.
Article 3 Right of Withdrawal
If you purchase goods from us (except for the exceptions listed below), you have 14 calendar days from the day after delivery to decide that you do not wish to keep the goods. You may then return your order without payment of a penalty and without giving a reason within 14 calendar days (you pay the shipping costs yourself). Within 30 calendar days after we have received your order back, we will refund the full purchase price of the returned goods, together with the original delivery costs. We will clearly inform you of this right upon confirmation of your order or at the latest upon delivery.
During the first 14 calendar days after the day of receipt, we expect you to handle the order and packaging carefully if you plan to return the goods. If you still want to return the goods as described above, you may only unpack them to the extent necessary to assess whether you wish to keep them. Given the nature of the goods, returned items must not have been used. This implies, among other things, that the packaging must be in good condition and not damaged (e.g. seals must still be intact).
If you return goods, this must be done together with all delivered accessories and — if reasonably possible — in the original condition and packaging, taking into account our instructions.
If you return goods, you are responsible for the transport and costs thereof. The right of withdrawal is only validly exercised when we have received the products back and the products are in good condition (as described above). If the products (wholly or partially) are lost or damaged in transport, or do not meet the above conditions, we cannot compensate you. We recommend that you take out appropriate insurance for this purpose.
Article 4 Pricing
During the period stated in our offer, our prices will not change, except for price changes resulting from changes in VAT rates.
Our prices include all taxes, VAT, levies and services. You will therefore never face surprises.
In addition to the purchase price, shipping costs are charged, which are stated before you finalize your purchase. These shipping costs are charged based on the rates applicable at the time of the order and depending on the size of the package and the destination. These prices may be changed at any time, as we are also dependent on external transport companies.
TheGhentist will regularly undertake promotional campaigns. These campaigns are always described as clearly as possible on the website. These campaigns run until stock is depleted. A user can never use two promotional campaigns simultaneously, unless TheGhentist clearly indicates otherwise. TheGhentist therefore reserves the right to adjust an order if we notice that, for example due to a technical error, two campaigns are running simultaneously on one or more products or product categories.
Article 5 Payment
Unless otherwise agreed with you, we only accept advance payment via our website. We accept both credit card and bank transfer payments.
If you notice inaccuracies in your payment details or something suspicious during your payment, you must immediately notify us at the email address
normally uses advance payment. If this is not the case and you have not paid in advance and you do not pay us on time or in full, we may charge you the costs you thereby cause. In any case, from the thirtieth day after the invoice date, without prior notice of default, you owe us interest of 10% per year on the outstanding invoice amount, as well as a flat-rate compensation of also 10% of the outstanding invoice amount. All goods we send you remain our property in any case until the moment you have paid for them in full. If you do not pay (on time), we may at any time decide to take them back at your expense. As long as you have outstanding invoices with us, you may not resell, give away, use as collateral or make immovable the goods delivered by us.
Article 6 Conformity and Warranty
We guarantee that our goods conform to your order and meet the normal expectations you may have, taking into account the product specifications. We naturally also guarantee that our goods comply with all laws existing at the time of your order.
To the extent that you notice upon delivery that the products do not conform to what was ordered (or are damaged), you must report this within 24 hours to theghentist.com by email at info@theghentist.com so that theghentist.com can safeguard its rights against the delivery service.
theghentist.com is however not a manufacturer and only distributes the products through its webshop.
Article 7 Delivery and Performance
All goods are delivered after payment to the address you indicated when placing your order. We do our utmost best to deliver everything ordered before 17:00 on the next or following business day (in Belgium). Due to external circumstances it may take longer. This is a best-efforts obligation and not a guaranteed result.
To the extent reasonably possible, and depending on whether the product is in stock, we deliver your order within 30 days of your order (and provided that the order and specific details are correct and complete), unless a longer delivery period has been agreed or indicated in advance. If we cannot deliver on time, we will always notify you before the expiry of this 30-day period. If delivery cannot take place within the maximum period of 30 days, you have the right to dissolve the agreement free of charge.
Goods and vouchers are always shipped at the risk of Theghentist.com. So you don’t have to worry about goods getting lost in the mail. However, if you return goods to us within 14 days of purchase because you prefer not to keep them, you are responsible for the transport.
Article 8 Force Majeure
In case of force majeure, we are not obliged to fulfil our obligations. In that case, we may either suspend our obligations for the duration of the force majeure, or definitively dissolve the agreement. You as a consumer also have the same right in case of force majeure.
Force majeure is any circumstance beyond our will and control that wholly or partially prevents the fulfilment of our obligations. This includes, among other things, strikes, fire, operational disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the website of the Online Retailer not being available at any time, non-delivery or late delivery by suppliers or other engaged third parties, etc.
Article 9 Intellectual Property
Our website, logos, texts, photos, names and in general all our communications are protected by intellectual property rights held by either us or our suppliers or other rights holders.
It is prohibited to use and/or make changes to the intellectual property rights as described in this article. For example, you may not copy or reproduce drawings, photos, names, texts, logos, colour combinations, etc. without our prior express written permission.
Article 10 Complaints Procedure and Disputes
We naturally always hope that all our customers are 100% satisfied. If you do have complaints about our services, you can use the complaints procedure described on our website. We do everything we can to handle your complaint within a reasonable period. All agreements we conclude with our customers, regardless of their place of residence, are exclusively governed by Belgian law.
